No Plea Bargain for Kidnap Kingpin Evans and Others as Nigeria Debates Justice for Victims

As the hearing date of convicted kidnap kingpin Chukwudumeme Onwuamadike, widely known as Evans, draws nearer, the issue of plea bargains in Nigeria’s criminal justice system has once again come under scrutiny. Evans, alongside his co-defendants, Victor Aduba and Linus Opara, stands trial before Justice Sherifat Sonaike of the Lagos State High Court on charges that include conspiracy, kidnapping, and attempted murder. These are serious crimes, and as the trial progresses, the question arises: should individuals involved in such heinous acts be allowed to negotiate a plea deal?

In May 2024, the prosecution revealed that both Evans and Victor Aduba had submitted an application for a plea bargain to the Lagos State Attorney-General, Lawal Pedro. While plea bargaining is an established legal tool in many jurisdictions and can save time and resources in legal proceedings, it has its critics, particularly in cases involving violent and organized crime. The defence’s request for a plea deal has sparked intense debate, with many questioning whether it would be appropriate to offer such leniency to individuals who have committed such grievous offenses.

Aduba’s lawyer, Mary Ibezue, revealed that after consultations with Evans, her client had decided to withdraw from the joint plea bargain application. Instead, a new plea deal was submitted solely for Aduba, creating further uncertainty around the handling of the case. Despite these developments, prosecuting counsel M.F. Salau confirmed that the Attorney-General was still reviewing the terms of the plea deal. The uncertainty surrounding the plea bargain application, especially after Aduba’s withdrawal, raises significant concerns about how seriously the Nigerian legal system treats cases of kidnapping, a crime that has wreaked havoc on countless families.

It is undeniable that plea bargaining can sometimes offer benefits, such as expediting trials and reducing the burden on overburdened courts. In February 2022, an Ikeja High Court sentenced Evans to life imprisonment for his role in kidnapping and conspiracy. A subsequent ruling in September 2022 sentenced him to 21 years for his involvement in further kidnapping activities. The severity of these past convictions, alongside the undeniable evidence of his criminal history, paints a clear picture of a dangerous individual. Evans’s prior actions—along with his ability to amass millions of dollars from kidnappings—highlight the dangerous nature of his criminal network, which has spread fear across Nigeria. This raises the crucial question: why should someone with such a track record be allowed the possibility of negotiating their sentence, especially when their actions have resulted in immense suffering for innocent victims?

What is even more concerning is the delay in the Attorney-General’s office in responding to the initial plea bargain application. The fact that the application sat on the desk for several months without a clear resolution only adds to the public’s anxiety. Why was there such a prolonged silence? Why was this request allowed to linger so long, especially when it involved individuals charged with such serious crimes? The lack of urgency in addressing this matter only fuels suspicions that the system may not be fully committed to delivering justice for the victims of kidnapping and other violent crimes. Now that a new application has been submitted exclusively for Aduba, many Nigerians are left wondering whether the Nigerian justice system will bow to the pressure of negotiated deals or whether it will take a firm stance in ensuring that justice is served.

Kidnapping is one of the most pressing security threats in Nigeria. What was once a crime largely confined to the Niger Delta region has since spread across the country, with abductions happening in various states. The case of Evans is a stark reminder of the financial rewards that criminal networks can derive from this crime. His reported ransom demands of up to $1 million per victim have made kidnapping an attractive and profitable venture for many criminals. The Nigeria Police Force even described him as “one of the richest criminals” in the kidnapping industry, a label that reflects the alarming scope of his operations.

The impact of kidnapping extends far beyond the immediate trauma experienced by the victims. It also has severe social, economic, and psychological consequences for the broader population. The fear of abduction has led to heightened insecurity across the nation, with citizens fearing for their safety in their homes, workplaces, and even places of worship. In many instances, families have been forced to sell their assets to raise ransom money, only to see their loved ones killed even after the payment. The emotional toll on families who have had to deal with the pain of losing a loved one, or the prolonged suffering of those who survive their ordeal, cannot be overstated.

Given the gravity of these crimes, it is essential that the Nigerian government takes a firm stance on how it handles such cases. While plea bargaining may have a role to play in certain instances, it should not be an option for those who have committed the most violent and damaging acts in society. Offering a plea deal to individuals like Evans and his co-defendants would send the wrong message to the public and could potentially embolden other criminals to engage in similar activities, knowing that they might be able to avoid the full consequences of their actions.

In the larger context of Nigeria’s ongoing battle with insecurity, the importance of holding criminals accountable cannot be overstated. Whether it is the armed insurgents of Boko Haram or the kidnappers like Evans, leniency and soft measures will only serve to exacerbate the problem. The country’s leadership must recognize the importance of maintaining public trust by taking a firm stance against criminality. Allowing those responsible for grave crimes like kidnapping to negotiate their way out of accountability could further erode the effectiveness of the justice system and embolden others to follow in their footsteps. Nigeria must demonstrate that it takes the safety and security of its citizens seriously by ensuring that those who perpetrate violent crimes are held to the highest standard of justice.

As the case of Evans continues to unfold, it is critical that the Nigerian justice system acts with urgency and conviction. It is essential that criminals who have inflicted such widespread harm on the nation are held fully accountable for their actions, and that victims receive the justice they deserve. If Nigeria is to move forward in combating its serious security challenges, it must adopt a tough and uncompromising approach toward violent crime.
