Court Orders Police To Pay ₦10m To EndSARS Protesters For Abuse

A Federal High Court sitting in Lagos has ordered the Nigeria Police Force to pay ₦10 million in damages to several #EndSARS protesters.

Justice Musa Kakaki delivered the ruling on Thursday, declaring that the protesters’ fundamental human rights were violated during the fourth #EndSARS memorial rally held on October 20, 2024.

Court Rules Police Acted Unlawfully

In his judgment, Justice Kakaki held that the applicants suffered harassment and intimidation at the hands of police officers. He noted that the victims were peacefully exercising their constitutional right to assemble and express dissent.

“The use of force, harassment, and unlawful detention against citizens engaged in peaceful protest is a clear breach of their fundamental rights,” the judge stated.

The court awarded ₦10 million in damages against the Nigeria Police as compensation for the violation.

Protesters Were Peaceful – Court Findings

The applicants, through their legal counsel, told the court they were marching peacefully at the Lekki Toll Gate during the memorial rally. They said police officers dispersed the gathering using excessive force and arrested several participants without cause.

Justice Kakaki agreed with the submissions, stating that the police failed to justify their actions under the law.

“Security agencies must act within the limits of the Constitution, especially when dealing with unarmed citizens,” he added.

Human Rights Advocates Applaud Verdict

Human rights groups and civil society organizations have welcomed the court’s decision. They describe it as a victory for civil liberties and a reminder of the state’s obligation to protect, not suppress, lawful protest.

Speaking to Channels Television, a representative of the Socio-Economic Rights and Accountability Project (SERAP) said the judgment reinforces hope in the judiciary.

“This is a strong message. Law enforcement must respect the rights of citizens at all times,” the spokesperson said.

Background: Fourth #EndSARS Memorial Rally

The October 2024 rally marked four years since the #EndSARS movement erupted nationwide in protest against police brutality. The memorial, held at the Lekki Toll Gate, attracted activists, victims’ families, and civil society groups.

Although largely peaceful, reports emerged of arrests and disruption by law enforcement agents, sparking renewed criticism of police handling of protests in Nigeria.

This judgment is one of the first major legal wins for #EndSARS protesters in recent years.
