In a historic move, President Joe Biden has commuted the sentences of 37 federal death row inmates, replacing their death penalties with life imprisonment without parole. In a statement, Biden expressed his conviction that the federal government must abandon the death penalty, asserting that justice does not require taking another life. While his clemency impacts federal inmates, it does not extend to the over 2,000 individuals sentenced to death by state courts, where executions remain a legal and contentious practice in many jurisdictions.
Biden’s decision arrives just weeks before Donald Trump, the former president and now president-elect, is set to take office in January. Trump, who revived federal executions in 2020 after a 17-year hiatus, has signaled intentions to expand the use of capital punishment to include human traffickers, drug dealers, and even migrants who commit crimes against U.S. citizens. Among those granted clemency are individuals convicted of heinous crimes, including murders during bank robberies, prison killings, and the murder of a prison guard. Biden made it clear that his decision is not an exoneration of these crimes. “I condemn these murderers, grieve for the victims of their despicable acts, and ache for all the families who have suffered unimaginable and irreparable loss, he said.
The decision also included disgraced former New Orleans police officer Len Davis, who orchestrated a murder while running a drug ring involving other officers. Despite federal moratoriums, state executions have continued under Biden’s presidency, with over 70 state-sanctioned executions carried out. Meanwhile, 23 states have abolished the death penalty entirely, and six others maintain moratoriums.
